Terms of Service

These Terms of Service govern access to Chiz, including accounts, event setup tools, browser photobooth sessions, galleries, sharing features, AI media tools, and related support services.

1. Definitions

In these Terms:

• "Chiz," "we," "us," and "our" mean the Chiz photobooth service.
• "Service" means the Chiz website, account tools, browser photobooth, event setup tools, galleries, sharing features, AI media features, APIs, and related support channels.
• "User" means an organizer, account holder, guest, attendee, operator, contractor, or other person who accesses or uses the Service.
• "Organizer" means the person or organization that configures, runs, or controls an event or photobooth session.
• "Event" or "Session" means a configured photobooth experience, gallery, capture workflow, or related media collection.
• "Content" means photos, GIFs, videos, audio, images, logos, overlays, backgrounds, prompts, generated images, text, event settings, and other materials uploaded to, captured through, generated by, or displayed in Chiz.

2. Applicability And Acceptance

These Terms apply to all use of Chiz. If you use Chiz on behalf of a company, venue, school, client, or event organizer, you represent that you are authorized to bind that organization to these Terms. If you do not agree, do not use Chiz.

Additional terms may apply to paid plans, app stores, third-party services, AI providers, payment processors, or specific event agreements. If there is a conflict, the more specific written agreement controls for that conflict.

3. Accounts, Authentication, And Security

You are responsible for the accuracy of account information, the confidentiality of credentials, and all activity under your account. Accounts are personal to the registered user or authorized organization and may not be sold, shared, transferred, or used to bypass access limits without Chiz's written permission.

You must promptly notify Chiz at support@chiz.cam if you believe your account, session link, QR code, gallery, device, or credentials have been compromised.

4. Service Performance And Availability

Chiz will use commercially reasonable efforts to provide the Service with care and skill. Chiz is provided on a best-efforts basis unless a separate written agreement expressly promises a specific result. The Service depends on browsers, cameras, devices, local networks, internet connectivity, hosting providers, third-party APIs, AI providers, email/SMS delivery providers, and venue conditions.

Chiz does not guarantee that the Service will be uninterrupted, error-free, compatible with every device, or available at all times. We may modify, suspend, limit, or discontinue features for maintenance, security, operational, legal, or product reasons.

5. Event Setup And Organizer Responsibilities

Organizers are responsible for configuring events, testing devices and internet access, choosing capture and sharing settings, preparing backup workflows, supervising guest use, and confirming that Chiz is appropriate for the venue and audience.

Organizers are responsible for providing clear notices and obtaining any legally required permissions, releases, or consents from attendees before capturing, recording, displaying, transforming, processing, or sharing guest media. This includes compliance with privacy, publicity, biometric, child-protection, venue, school, employment, and event-specific rules that may apply.

Organizers are responsible for all Content visible in photos, videos, overlays, templates, logos, backgrounds, stickers, prompts, generated outputs, gallery titles, event names, and shared media links.

6. Guest Use

Guests may use Chiz only as authorized by the organizer and these Terms. Guests must not interfere with an event, misuse sharing tools, access galleries or sessions without permission, upload unlawful materials, or use Chiz to harass, impersonate, exploit, or harm others.

7. Content Ownership And License

You keep the rights you already have in Content you upload, capture, or generate through Chiz. You grant Chiz a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transform, display, transmit, generate, modify, and share Content as needed to provide, secure, support, and improve the Service and to fulfill organizer-configured workflows.

You represent that you have all permissions needed for Content you provide to Chiz, including permissions from people who appear in photos or videos and rights to any logos, music, artwork, branding, prompts, or other materials you upload or use.

8. AI-Generated And AI-Modified Content

Chiz may offer AI-assisted features such as AI Makeover, AI Transform, patch/stitch outputs, background removal, style transformations, scene changes, outfit changes, and similar generated or modified media tools. These features may use Chiz-controlled processing and third-party providers, including Google AI Studio/Gemini and fal.ai.

For AI features that use Google AI Studio or Gemini image models, original files, derived files, prompts, and generation parameters may be processed by Google only as needed to generate the requested output. Outputs generated through Google AI services are subject to Google's terms and privacy policies, including https://policies.google.com/terms and https://policies.google.com/privacy. If Chiz makes available a Gemini model or feature commonly referred to as Gemini Nano Banana or another Gemini image model, the same user responsibilities and provider terms apply.

For AI features that use fal.ai, source images, prompts, and output requests may be processed by fal.ai. fal.ai terms and privacy information are available at https://fal.ai/legal/terms-of-service and https://fal.ai/legal/privacy-policy.

AI systems are not fully predictable. Outputs may be inaccurate, unexpected, offensive, distorted, biased, or unsuitable for a particular event or audience. Chiz applies reasonable safeguards, which may include prompt constraints, negative prompts, product limits, filtering mechanisms, and review controls to reduce the risk of nudity, explicit content, illegal content, or other inappropriate outputs. Chiz cannot guarantee that such content will never appear and is not liable for AI-generated or AI-modified outputs to the fullest extent permitted by law.

Users and organizers are solely responsible for reviewing AI outputs before displaying, retaining, publishing, downloading, printing, or sharing them. Users must not use AI features to create unlawful, non-consensual, deceptive, harassing, exploitative, infringing, sexually explicit, or harmful content, including content involving minors or private individuals without appropriate permission.

AI-generated images may include provider-generated metadata, watermarks, provenance signals, or synthetic-content marks, such as Google SynthID where supported. Chiz does not guarantee that every output will include or preserve an AI mark after download, editing, compression, sharing, or third-party handling.

9. Sharing, Galleries, And Delivery

Chiz may allow media sharing through public or private links, galleries, QR codes, native share sheets, email, SMS, WhatsApp, downloads, casts, or other configured methods. Organizers are responsible for choosing appropriate sharing settings and informing guests how media may be distributed.

Chiz is not responsible for unauthorized access caused by forwarding, posting, guessing, photographing, or otherwise distributing gallery links, QR codes, session identifiers, or downloaded media. Chiz is not responsible for messages or media that are delayed, blocked, filtered, undeliverable, or incorrectly addressed because of user-provided contact information, carrier behavior, provider outages, spam filtering, or network conditions.

10. Payments, Plans, Credits, And Billing

If Chiz offers paid plans, subscriptions, event licenses, creative credits, AI generation credits, add-ons, or other paid features, prices, taxes, billing cycles, renewal terms, usage limits, and refund rules will be presented at purchase or in the applicable written agreement. You authorize Chiz and its payment providers to charge amounts due for selected products or services.

Unless otherwise stated in writing, paid access may be suspended or terminated for non-payment, chargebacks, suspected fraud, or misuse. Creative credits, AI credits, trials, demos, promotional access, and event licenses may expire, be limited, or be revoked if abused.

11. Prohibited Uses

You must not use Chiz to:

• Violate law, infringe rights, or breach privacy, publicity, or intellectual-property obligations.
• Capture, upload, generate, display, or share unlawful, explicit, exploitative, hateful, harassing, deceptive, or harmful Content.
• Create or distribute non-consensual intimate imagery, sexualized content involving minors, or content intended to impersonate or defame a person.
• Access accounts, sessions, galleries, APIs, storage, or systems without authorization.
• Bypass security, usage limits, watermarks, trials, credits, billing controls, or content safeguards.
• Reverse engineer, scrape, overload, interfere with, or disrupt Chiz or its providers.
• Share credentials, resell access, or operate Chiz for a third party without authorization.

12. Third-Party Services

Chiz may integrate with or rely on third-party services such as authentication providers, hosting providers, storage providers, email providers, SMS or WhatsApp providers, payment processors, app stores, AI providers, analytics, diagnostics, and support tools. Your use of third-party services may be governed by their own terms and privacy policies. Chiz is not responsible for third-party services that it does not control.

13. Intellectual Property

Chiz owns or licenses the Chiz name, logos, software, interface designs, workflows, documentation, templates, default assets, service architecture, and related materials. These Terms do not transfer ownership of Chiz materials to you. You may use Chiz only as permitted by these Terms and any applicable plan or agreement.

14. Privacy

The Chiz Privacy Policy explains how Chiz processes personal information and event media. By using Chiz, you acknowledge that Chiz will process information as described in that policy.

15. Suspension And Termination

Chiz may suspend or terminate access to the Service, accounts, events, galleries, files, or features if we believe a user has violated these Terms, created risk for Chiz or others, failed to pay amounts due, misused trials or credits, violated law, or compromised service security. You may stop using Chiz at any time. Some obligations, including payment obligations, indemnities, liability limits, ownership terms, and dispute provisions, survive termination.

16. Disclaimers

To the fullest extent permitted by law, Chiz is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. Chiz disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted operation, and error-free performance.

17. Limitation Of Liability

To the fullest extent permitted by law, Chiz will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost media, lost data, lost business, event disruption, reputational harm, third-party provider failures, network failures, device incompatibility, guest conduct, organizer configuration choices, or AI-generated outputs.

To the fullest extent permitted by law, Chiz's total liability for any claim relating to the Service will not exceed the amounts paid to Chiz for the specific event, plan, or service giving rise to the claim during the three months before the claim arose, or one hundred U.S. dollars if no amount was paid.

18. Indemnification

You agree to defend, indemnify, and hold harmless Chiz from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your Content, your event, your violation of these Terms, your violation of law, your failure to obtain permissions, or your dispute with a guest, organizer, venue, client, provider, or third party.

19. Force Majeure

Chiz is not responsible for delay or failure caused by events outside its reasonable control, including internet or power outages, provider failures, labor disputes, natural disasters, war, terrorism, civil unrest, epidemics, government action, venue restrictions, device failure, browser changes, or denial-of-service attacks.

20. Changes To The Service Or Terms

Chiz may update the Service and these Terms from time to time. Updated Terms will be posted at https://chiz.cam/tos with a revised effective date. Continued use of Chiz after changes take effect means you accept the updated Terms.

21. Governing Law And Disputes

Unless a separate written agreement says otherwise, these Terms are governed by the laws applicable in the jurisdiction where Chiz is operated, without regard to conflict-of-law rules. Any dispute must be brought in a court with proper jurisdiction unless the parties agree to another lawful dispute-resolution process.

22. Severability

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted or replaced to best accomplish its original purpose within the limits of applicable law.
